A Law for Real and Effective Equality of Trans People was approved on Tuesday, June 29 by the Council of Ministers of Spain and provides that minors under 12 and 13 years of age can change their sex and name in the Civil Registry with a judicial authorization. From the age of 14, they will be able to do it with a simple administrative procedure, without evidence or witnesses.
The text, which you can read here (in Spanish), affirms that the will of the person will be the only requirement for the change of sex and name, without the need for medical and legal reports or guardianships; determines that the administrative process will last a maximum of four months; modifies the Civil Code so that lesbian and bisexual women can proceed to the filiation of their children without having to be married; and eliminates the terms mother and father replacing them with “parents”.
It also prohibits therapies and psychological counseling for people who want to treat their homosexual tendencies or gender dysphoria; guarantees lesbians, bisexuals and “trans people” access to assisted reproductive techniques; in the case of hermaphroditic babies, genital modification surgeries are prohibited at birth and the parents are given a period of 12 months before registering their sex in the Registry.
It establishes the inclusion of gender ideology in the educational curriculum of all stages, as well as teacher training; it prohibits “employment discrimination” for reasons of “sexual diversity and gender identity”, and imposes infractions and sanctions that reverses the rules regarding the burden of proof when it comes to discrimination against the LGBT community. If you are accused of discrimination, it will be up to you to prove that you did not discriminate.
The law is the work of the PSOE and Podemos, and especially of the current Minister of Equality, Irene Montero.
Widespread rejection
The initiative has generated a great controversy, feminist groups and people who consider themselves transsexuals have expressed their rejection. According to a survey carried out by NC Report for the newspaper La Razón, carried out between July 1 and 3, 70% of those interviewed are against “gender self-determination.”
Also, 68% are against that adolescents are being able to change their sex from the age of 16 without parental permission, 67% are against the reversal of the test in case of discrimination complaints and 53% are against the imposition of sanctions. 49% believe that the law goes against the claims of traditional feminism, and 51% that it will affect women’s sport.
Women summoned by the “Confluencia Movimiento Feminista” and “8M Movimiento Feminista de Madrid” collectives have demonstrated in the streets against the Trans Law. They accuse the Ministry of Equality of promoting laws against women that substitute the concept of sex for that of gender and endanger their rights.
In their view, the law, by preventing a different diagnosis of gender dysphoria, will also harm trans people, since it will end the dismantling of the integral units in which they now receive treatment.
With cries of “childhood is not touched”, they have denounced that associations of the “queer” movement, through affective sexual education, “induce” children to think that there are boys and girls who have been born in the wrong body , “provoking doubts” and guiding them towards a transition to the opposite sex.

In an article published by Libertad Digital, several people who consider themselves transsexuals express their repudiation of the new law and assure that it is a “barbarity”, that they are ashamed that an ideological instrument is used in their name and warn of the dangers that it generates the childhood.
